Verbal Contract with Money changing hands?

Myself and a couple of associates decided that we would put together a team that would provide services to individuals and businesses. Each of put $2500.00 into an account to be used for equipment, training, marketing, etc,etc… It was also agreed upon that no actions would be taken unless a margority agreed to the action. First I need to state that we are working as sub-contractors, and without certain business licenses’s and insurance it is illegal for us to present contracts for service.

1 team member took it upon himself to draft a contract, and sent it to a business that in turn contacted the rest of the team telling us. This member did so solely on his own and against what the team had told him to do. But because he represted the team made all of us guilty of a class1 misdemenor. As a result we want to remove him from the team. He is a loose canon we want to remove from the team, but are worried about a law suit. We don’t need that before we really get started.

Do you consider this person to be a loose canon simply because of what he did? If so, rethink your strategy.

This person could be the person that stabilises your team, and that move could go well for the future.

An alternative slant I know, but good luck with your venture anyway.
