question about contractor problem?

i had a guy put pavers in my back yard. he did a very good job, but there is a pile of dirt in my driveway from where they dug up for the pavers. he says he will send a dumpster “soon” to pick it up. How long should I wait? If he doesn’t get it within 2 weeks, do I have grounds to hire someone else and deduct it from his final payment? Any ideas of the legality of that?

Be sure to have pictures of his SHODDY work just in case this goes to court. I wouldn’t give him another penny, no matter how much is owed. He didn’t complete the work in a timely manner.
