Legal rights – contractor stopped working?

I paid my contractor on schedule for my dormer I hired them to do. I found out he has NOT been paying the contractors HE hired to do the work though. The window company placed a mechanics lien on my home, the sheet rock guys is going to do the same. He has 90% of the money (about 100K) and there is about 35K in work left to do (about 25-30% of the total)

I found he is filing bankruptcy and other people are in the same boat as I.

What are my options? Suffolk Count, NY

I filed with better business bureau and consumer affairs – both can do little or nothing.

I have a home that is barely livable and not enough money to pay for it. I was hoping to refi after the job was done at a low rate and pay off all debt accrued due to this because my house would have nearly doubled in value.

Any help… I seek direction.

Unfortunately you are in a tough spot, with the GC, general contractor going BK before paying the subs,

The subs are well within their rights to place lien on the property where the work was completed, even though you paid the GC for their work, if the GC failed to pay them, so most likely the liens are valid

Therefore leaving the GC as the only legal avenue for recourse, but in your case the GC is filing for BK

Going to need to lawyer up to see if you can pierce the corp. veil and sue the GC personally, assuming he/she has personal assets left from the BK, if not only other chance for some sort of satisfaction maybe criminal fraud charges, but that is something the AG office will have to investigate
