can a subcontractor sue me over a year later when he fails to file a lien and the contractor doesn’t pay him?

I paid my contractor and he didn’t pay one of his subs. I didn’t ask for a lien release since he never filed a pre-lien. A year later, the sub sues me stating the contractor never paid him. I never even talked to the subcontractor. can he do this, and win?

He sure can. It is called a mechanics lien. Happens all the time. A fly by night contractor hires a sub, collects for the work done then either skips or declares bankruptcy. As the beneficiary of the work you are liable. Dirty pool, but you are on the hook. Your only recourse is a lawyer and see if you can sue your contractor. Good luck.
