What is the difference with an employee and a subcontractor?

if you are a Contractor, owing money to a second party and an attorny steps in and sews you for moneys owed. Can he go to your customers and demand garnishee payment from them. On believing that you are not an private contractor, but an employee and seeking to garnish your pay. Can this legally be done?

If the first part of your question is as simple as it sounds; A sub-contractor is a person/person hired by a General Contractor to specialized work, i.e., HVAC, Plumbing, Electrical, etc.

I don’t know about anywhere else, but in Pennsylvania there are what are called “mechanics liens”, this is an agreement between the owner of the project and the GC that all Subs will be paid by the GC, so that the Subs can’t sue the owner of the project.

As far as garnishing employee wages, I’m sorry that doesn’t make sense.
