Can an individual put a lien on another individuals name and credit in NYS?

A person made an investment in a property, but the check was not sent to the individual, but it was used as a down payment. The individual that made the investment wants their funds back before the property is renovated. The funds have been sent to the contractor for renovation. Can the investment individual put a lien on the name and credit of the mortgage holder, if the funds have been sent to the contractor and the property has not been renovated? If so, how do they go about getting the lien and what are the statutes of limitations?

I doubt it. But, regardless of my doubts you need a court order.
