victim of contractor fraud due to hurricane katrina?
I am at my wits end with this matter, I am a victim of contractor fraud due to hurricane katrina. his name has been turned over to the DAs office in New Orleans. The waiting processing is horrible because their office is bombarded. We have another contractor that is license….but the mortgage company will not turn over the last portion of the money, until they get a letter from the first contractor stating he has relinquish his services and/or once the case goes to court get a judge to relinquish his services. This process will cause us to loose our home. Is there another way or quicker way to get to a judge. What can we do, we have explained to the mortgage company and have documented paper work?
You may go to court asking for a Temporary Restraining Order (TRO) against the mortgage company and explain your status. It is a type of injunction. An injunction is an equitable remedy in the form of a court order, whereby a party is required to do, or to refrain from doing, certain acts. The party that fails to adhere to the injunction faces civil or criminal penalties and may have to pay damages or accept sanctions for failing to follow the court’s order. In some cases, breaches of injunctions are considered serious criminal offences that merit arrest and possible prison sentences.
a temporary restraining order (or TRO) may be issued on a short-term basis. TROs usually last until a hearing date for the TRO at which the court decides whether to drop the TRO or to issue a preliminary injunction based on the TRO. You should take advice from a local attorney for this.
