Responsible Contractor

Please show the code that states that a contractor is held responsible when a subcontractor has no work comp?

If a contractor hires subcontractors and they do not have the required workman comp insurance in place for their employees where can you find the code that this is the contractors responsibility.now. I have been told repeatedly that my husband’s injury should also be covered by the main contractor but our attorney wants the code or something proving this in Iowa to go after the main contractor to. The company he worked for left my husband in a knee brace for three weeks before we found out there was no insurance, they wouldn’t pay for treatment and left him with no income and in a brace. It took us three months to find a surgeon to do the surgery and we lost our home to the bank because of it. I think the companies involved could have resolved this better.
our attorney seems to think that the main contractor is not responsible and we think they are. I am ready to fire our attorney as I don’t think he knows what he is doing in our case.

If I were you I would contact the Workers Compensation Insurance Commissioner for Iowa, they should be able to answer your question since they handle the administration of the law, i.e. they are the Government entity that enforces the law in your state. I would also consider obtaining the services of another attorney. Get a referral for an attorney that specializes in workers compensation from the local bar association or from the law school of a university in your area. By using an attorney that does not specialize in w/c cases you are doing yourself a grave disservice.
