Help!! Defining Independent Contractor Vs. Employee. I have read alot online, but to make it more concise…?
it says if the work is an inter gal part of the business your employee… so if you sell clothes at a boutique your an employee…. a dance teacher at a dance studio? You choreograph and structure your classes, but the owner watches you, sets schedules, and definitely if she doesn’t like what your doing, you hear about it and have to correct yourself so you do it her way…is this employee status?
You are not necessarily an employee based on the information you have given. If you are the one who must go out and find the customers and her requirements to change what you do are rare and reasonable then she could argue that you are a contract worker.
It is a complicated area of law and I would need more information.
Also, before you file a form to protest and say you are an employee, remember that she will be pretty mad that you did that and could hold it against you. That may not be fair or legal but it is a real world concern. Also remember that if you are claiming any expenses you get to take them all on a schedule C but they will be limited on a schedule A as an employee.
